Understanding SUNY Binghamton In-State Tuition Requirements

However, merely being physically present in New York for the sole purpose of attending a New York State campus does not automatically grant New York State domicile.
Key Factors in Establishing Domicile
Several factors are considered when determining domicile:
- Physical Presence: A student is required to have at least a 12-month current/consistent physical presence in New York State before applying.
- Intent to Make a Permanent Home: Establishing a legal domicile in New York State involves residing in the state with the intention of making a permanent home. Pursuit of an education is considered a special or temporary purpose. Intention cannot be anecdotal or emotional in nature.
- Actions Demonstrating Intent: Campuses rely on documents and circumstances such as, but not limited to, the following to determine if an individual's domicile is in New York State. Within your first few months in New York State, you apply for your NYS driver's license or non-driver identification card, motor vehicle registration and voter registration card. Utility bills such as gas and electric, water, cable, etc. are also considered.
Who Can Claim Residency?
Citizens of the United States, permanent residents, or non-immigrants with a Visa which permits them to establish a United States residence may be eligible for in-state tuition.
Financial Dependency and Residency
Individuals who are financially dependent and whose custodial parent(s) lives in a state other than New York are generally not eligible for the resident tuition rate. A financially dependent student takes residence from the parent/legal guardian on whom the student is dependent.

Application Process for Residency
To apply for New York State residency, please provide the completed application along with the necessary documents. Applications that are missing information or documentation will not be accepted. Residency applications and supporting documentation are submitted online via the my.binghamton.edu portal. You can access the application, using the forms linked above.
Application Deadlines: The completed application must be notarized and submitted by the end of the second week of the term which the applicant is seeking NYS residency status. Failure to submit an application by the deadline will result in full out-of-state tuition liability for that term. If you do not apply for residency by the due date on your bill, you will be required to pay the out-of-state rates.
Application Forms Based on Dependency Status:
- Dependent Student (Under 24 and claimed as a dependent): Complete Part A & C, sections 1 & 2 of the application. This requires information from parents or legal guardians.
- Independent Student (24 or older, married, a parent, a veteran, or otherwise self-supporting): Complete Part A & C, sections 1 & 3 of the application.
- All Students: All students must sign Part A. Students must also sign the attestation on Part C, section 3.
Important Note: Processing times will vary depending on application volume. Residency status will be made by the Office of Student Accounts in accordance with SUNY policy.
Special Circumstances
- High School Graduates: Non-resident students may be eligible for resident tuition if they have graduated from a New York high school or received a NYS high school equivalency diploma within 5 years of application to SUNY. Note: Non-resident students, including undocumented students, who attend for at least two years and graduate from a New York high school may be eligible for resident tuition.
- To demonstrate this, students may provide a York State high school diploma.
- Members of the US Armed Forces: Members of the US Armed Forces who provide documentation showing that they are full-time active duty and stationed in New York State shall be charged in-state tuition regardless of the actual location of their domicile.
- Dependents of US Armed Forces: Dependents of a parent or legal guardian who is a full-time active member of the US Armed Forces stationed out of State will qualify for in-State tuition provided that the parent or legal guardian submits proof of a New York State residency, referred to as a "Home of Record."
- Students Without Lawful Immigration Status: If the student is without lawful immigration status, the student submits to the campus a notarized affidavit stating that the student has filed an application to legalize his or her immigration status or will file such an application as soon as he or she is eligible to do so. (See NYS Education Law §355(h) (8)). Such affidavit shall be viewed by the appropriate campus official, and either destroyed or returned to the student. The appropriate campus official making the residency determination shall fill out a form indicating that the student has provided all the appropriate information to the campus if the student is then eligible for in-state tuition.
Documents for Residency
For documents not meeting the 12 consecutive months requirement, additional documentation may be requested to support the claim of residency.
Certificate of Residence
Students may utilize this certificate of residence application form to obtain a certificate of residence from your home county. You must obtain the certificate of residence from your home county no later than 30 days after the first day of classes at your college. Please note that the only way in which a denial of your certificate of residence can be successfully appealed is if the county or community college failed to take proper action under the regulations here. Simply not submitting your application within the deadline is not an adequate reason to appeal.

Appealing a Residency Determination
Students who would like to appeal their residency determination must do so in writing within 30 days of receiving notice of the denial. The letter of appeal must clearly state the reason for appeal. Any documentation to support the appeal should be submitted to the Bursar's Office, Room 200, CAB.
