Defining Universal Court Reporting in the Modern Legal Landscape
Court reporting plays a vital role in the legal system, ensuring accurate and reliable records of legal proceedings. This article explores the concept of universal court reporting, encompassing its various facets, services, and the evolving role of court reporters in today's litigation environment.
The Core of Court Reporting
At its core, court reporting involves capturing witness testimony verbatim and getting it into our client’s hands expeditiously is the goal. This may include depositions, arbitrations, meetings, construction sites, examinations under oath, trials, and aids of execution, medical malpractice cases, etc. Court reporters are, in essence, the keepers of the record, not only as keeper of the record, but throughout the litigation process.
Methods of Court Reporting
When we think of court reporting, we most often think of the stenographic method. However, there is more than one method used in reporting. Another method found in many areas is the "mask" reporter, who uses a mask to speak into, which is recorded on audiotape for later transcription. In some instances, you may find a "tape" recorder.
Official vs. Independent Court Reporters
Court reporters that work for judges and the courts are generally referred to as official court reporters. However, this is not the only type of reporter. As the need arose for an officer of the court to provide reporting services outside the courtroom, the independent court reporter emerged. Official court reporters were typically employed by the court system within which they worked, while independent reporters work on a contract basis. This is common, for example, in the state of Florida, where a reporter is actually an independent reporter. There is also the independent reporter that works individually as a sole practitioner, serving their own clients. Sole practitioners are also more common in rural areas.
Services Offered by Court Reporting Firms

The Importance of Universal Representation
Universal representation in the legal system ensures that everyone, regardless of their background or circumstances, has access to due process. This model is particularly crucial in immigration law, where the consequences of inadequate representation can be severe.
Ensuring Access to Due Process
Universal representation means representation for all, regardless of the perceived likelihood of the case succeeding, the client’s residency, or the client’s previous contact with the criminal justice system. Universal representation does not predict the outcome of a case, but it does ensure access to due process for all. Adopting due process exclusions further eliminates the opportunity to provide a critical check on how the immigration enforcement system treats criminal convictions. An attorney is crucial to holding the government to its burden to prove that the law requires that an individual be deported.

Positive Outcomes and Procedural Justice
Research has consistently demonstrated a strong relationship between the assistance of counsel and case outcomes in general. The universal representation model, specifically, also generates positive outcomes even when cases are not selected based on their perceived likelihood of success. Regardless of a case’s ultimate result, there is real value in empowering clients to understand the options before them and subsequent outcomes. Representation gives clients an opportunity to have their voices heard, becoming more actively engaged in their own fate, rather than being silenced. This is known as procedural justice, where the fairness and transparency of the proceedings themselves bring a form of justice regardless of the case outcome.
Scalability and Long-Term Planning
The universal representation model is scalable in a way that a triage model is not. A universal representation pilot program lets program managers develop long-term strategic plans and test and identify appropriate levels of staffing, caseloads, and other resources before expanding to serve larger numbers of people with the goal of full-scale universal representation.
The Impact on Detention and Release
For many immigrants, being released from detention may be almost as important as the ultimate legal outcome. Representation is critical to releasing them from custody, just as it is to the ultimate outcome of the case. Attorneys play a crucial role in not only securing their clients’ release from custody-allowing them to return to their families and livelihoods in the community-but in ensuring that those clients subsequently appear in court.
Economic and Social Benefits
Representation generates practical cost savings for communities and the economy at large. Work authorization allows people to participate in the formal economy by holding jobs, generating tax revenue that benefits all levels of government. Representation also mitigates bias from the distribution of legal services, whereas a triage model reinforces the notion that some are worthier of due process and representation than others.
Factors Influencing the Cost of Court Reporting
The cost of court reporting services can vary significantly based on several factors. Understanding these factors can help legal professionals make informed decisions and control costs.
Page Rate and Additional Charges
The "page rate" is the most universal measurement of cost. However, what should be aware that might not be as obvious or clear as a quoted page rate. Want to consider the definition of a page. A $4 page containing 25 lines and 50 to 60 characters per line is less expensive than a $3 page containing 20 lines. Need to know the total page count and whether there is an appearance fee as well as a page rate charge. Also need to know if it is an hourly charge or per diem charge, and whether there are administrative charges.
Transcript Copies and Formats
At what page rate are additional copies billed? The basic rate while most require an original and one copy be included. Do you need some form of a condensed transcript? Do you require a key word index? Can you use an ASCII disk? Is your software compatible if other disk formats are needed?
Video Services
Do you need to videotape the deposition? Does the videotape need to be date and time stamped? Will the video be for possible trial presentation or other use? If so, what are those costs?
Delivery Time and Additional Services
What is the normal delivery time for a transcript? Are there extra charges for using them? Is video teleconferencing an option? Do you need a real-time stream at the deposition? What is the extra cost for this service? What about a concordance? What is the cost for this service?
Skills and Certifications
Court reporters must possess considerable skill sets to successfully perform in the marketplace, including a strong command of grammar, and the terminologies used by almost every kind of professional imaginable. The National Court Reporters Association (NCRA) offers certifications such as the Registered Professional Reporter (RPR) Certification. To obtain this certification, reporters must pass a skills test consisting of literary and jury charge material at 180 wpm and of testimony/questions and answers at 225 wpm. In transcribing their notes, a minimum 95 percent accuracy is required to pass this first level. They must also take and pass a written knowledge and written skills test. The next level is the Registered Merit Reporter (RMR). To meet the requirements, a person may apply to take the RMR exam, which also has components including a written knowledge test. The skills test consists of literary at 200 wpm, jury charge at 240 wpm and testimony/Q&A at 260 wpm. The more certifications are held.
