Brown v. Board of Education is often regarded as an iconic case, representing the pursuit of equality and justice. However, its true meaning and radical mandate are often overlooked or resisted. The Radical Mandate of Brown v. Board
Brown v. Board of Education condemned the belief system that justified segregation, making it a radical case with a radical mandate. Commonly referred to as The Segregation Cases, Brown consolidated five cases from Kansas, South Carolina, Delaware, Virginia, and the District of Columbia, highlighting the national scope of segregation.
The Supreme Court's decision rested on two key principles:
- Segregation is unconstitutional because it is "inherently unequal."
- It violates the equality principle, which is central to the nation's identity.
To fully grasp the comprehensive mandate of Brown, it is essential to understand the pervasive harm caused by segregation. The purpose of segregation was to replace and restore white supremacy and racial hierarchy, which had been threatened by the abolition of slavery. This system aimed at dehumanization and inflicting psychological harm on Black individuals.
Slavery was a comprehensive system that was reinforced both socially and legally. Racial identity played a crucial role, with Black racial identification rooted in the presumed lack of humanity. Hegemony linked structured and pervasive inequality, while social science traditions contributed to beliefs of White superiority. Segregation, therefore, represented a transformed and reconstituted form of slavery. The two are inextricably linked.

Declaring segregation unconstitutional was a radical step that required acknowledging the totality of the system and creating its opposite: a multiracial, comprehensive equality system. In such a system, Black people would be recognized as equals with equal humanity, while white people would reshape their identity away from a presumed standard of health and well-being.
The Plessy Decision: Establishing "Separate but Equal"
In 1892, Homer Plessy, an African American man, refused to give up his seat to a white man on a train in New Orleans, violating Louisiana state law. His subsequent arrest led to the landmark case of Plessy v. Ferguson.
By an 8-1 vote, the Supreme Court ruled against Plessy in 1896. Justice Henry Billings Brown, writing the majority opinion, stated that the Fourteenth Amendment was intended to enforce equality before the law, but "could not have been intended to abolish distinctions based upon color, or to endorse social, as distinguished from political, equality." He further asserted that if one race was inferior to the other socially, the Constitution could not elevate them to the same plane.
Justice John Marshal Harlan, the lone dissenter, offered a contrasting interpretation, stating, "Our Constitution is color-blind, and neither knows nor tolerates classes among citizens." Harlan's dissent became a rallying cry for future generations working to dismantle segregation.
The Road to Brown: Challenging Segregation
Despite the Plessy ruling, the fight against Jim Crow laws and racial discrimination continued. The National Association for the Advancement of Colored People (NAACP), founded in 1909, played a pivotal role in this struggle.

From 1935 to 1938, Charles Hamilton Houston led the NAACP's legal arm, working with Thurgood Marshall to devise a strategy to challenge Jim Crow laws in education. Their approach involved demonstrating the inequalities between Black and white schools, ultimately undermining the "separate but equal" doctrine.
Early Cases Challenging "Separate but Equal"

- Pearson v. Murray (Md. 1936): Thurgood Marshall argued that Donald Gaines Murray was equally qualified as white applicants to the University of Maryland School of Law and that his rejection was solely based on race. He further argued that the Black law schools were not of the same academic caliber as the University's law school, violating the principle of "separate but equal." The Maryland Court of Appeals ruled in favor of Murray, ordering the law school to admit him.
- Missouri ex rel Gaines v. Canada (1938): Lloyd Gaines, a graduate of Lincoln University in Missouri, was denied admission to the University of Missouri Law School because of his race. The state offered to build a Black law school or pay for Gaines to attend law school in another state. Gaines, with the help of Thurgood Marshall and the NAACP, sued the state. The Supreme Court sided with Gaines, stating that since a law school for Black students did not exist in Missouri, the "equal protection clause" required the state to provide legal education for Gaines within its boundaries.
- Sweatt v. Painter (1950): Heman Sweatt, an African American man, applied to the University of Texas Law School, which was exclusively for white students. The University created an underfunded law school for Black students. Sweatt, with the assistance of Thurgood Marshall and the NAACP, sued to be admitted to the University's law school for white students. The Supreme Court unanimously sided with Sweatt, citing the blatant inequalities between the University's law school and the hastily erected school for Black students.
- McLaurin v. Oklahoma Board of Regents of Higher Education (1950): George McLaurin, an African American man, was admitted to the University of Oklahoma's doctoral program but was required to sit and eat separately from his classmates. McLaurin sued to end these practices, arguing that they negatively impacted his academic pursuits. The Supreme Court ruled that the University's actions were adversely affecting McLaurin's ability to learn and ordered that the practices cease.
Brown v. Board of Education: The Landmark Case
Brown v. Board of Education was a consolidation of five cases challenging the "separate but equal" concept in public schools:
- Brown v. Board of Education of Topeka
- Briggs v. Elliot
- Davis v. Board of Education of Prince Edward County (VA.)
- Bolling v. Sharpe
- Gebhart v. Belton

After the case was reheard, Chief Justice Warren united the Justices to support a unanimous decision declaring the concept of "separate but equal" in public schools unconstitutional. On May 17, 1954, he delivered the opinion of the Court, stating, "We conclude that in the field of public education the doctrine of 'separate but equal' has no place. Separate educational facilities are inherently unequal."
The Court's decision in Brown partially overturned Plessy v. Ferguson, which had allowed racial segregation as long as facilities were equal. The case specifically addressed the public school system in Topeka, Kansas, where Oliver Brown's daughter was denied enrollment at the school closest to her home and was instead required to attend a segregated Black school farther away.
The Legal Arguments and Rationale
The plaintiffs in Brown argued that racial separation in schools, despite claims of equal treatment, perpetuated inferior conditions and treatment for Black Americans. This argument was influenced by UNESCO's 1950 Statement, "The Race Question," which denounced racism and attempts to justify it scientifically.
The Supreme Court recognized the evolving social and governmental landscape of the United States since the late 19th century. It acknowledged that public schools were less common in the South during the 1860s. The Court also noted the disparity in resources and facilities between Black and white schools during the segregation era, despite the "separate but equal" doctrine.
The Court concluded that separating Black children from others of similar age and qualifications solely because of their race generates a feeling of inferiority that can have lasting negative effects. This sense of inferiority affects a child's motivation to learn. The Court stated that "Whatever may have been the extent of psychological knowledge at the time of Plessy v. Ferguson, this finding is amply supported by modern authority."
Reaction and Resistance to Brown
While many Americans celebrated the Brown decision, it faced strong opposition, particularly in the South. The reaction of white Southerners was described as "noisy and stubborn." Some border states integrated their school systems, while others allowed only token integration.
African-American teachers, principals, and other school staff who worked in segregated Black schools were often fired or laid off as Southern states attempted to create integrated schools with white leadership. Texas Attorney General John Ben Shepperd launched a campaign to create legal obstacles to desegregation.
In September 1957, Arkansas Governor Orval Faubus used the Arkansas Army National Guard to prevent the "Little Rock Nine," a group of nine black students, from entering Little Rock Central High School. President Dwight D. Eisenhower intervened by sending federal troops to enforce desegregation.
Florida's response was mixed, with the legislature denouncing the decision and attempting to delay its implementation.
The Aftermath and Legacy of Brown
Brown v. Board of Education was a watershed moment in the Civil Rights Movement. It legally dismantled segregation in public schools, paving the way for further advancements in racial equality. However, the decision's implementation was met with resistance, and de facto segregation persists in many areas today.
The case serves as a reminder of the importance of challenging systemic inequality and upholding the principles of equality and justice for all. It also underscores the need to address the underlying beliefs and attitudes that perpetuate discrimination.
The Unfulfilled Mandate and Ongoing Challenges
Despite the landmark ruling, the radical mandate of Brown remains largely unfulfilled. Seventy years later, educational and other inequalities persist, rooted in the failure to fully implement the decision's vision of comprehensive equality.
Dehumanization traditions continue to impact both Blacks and Whites, perpetuating inequality and undermining humanity. Black and brown children and adults continue to suffer disproportionately from the failure to achieve comprehensive equality.
